Kuvings Germany – Terms and Conditions
§1 Scope and Customer Information
The following General Terms and Conditions (GTC) govern the contractual relationship between NUC Electronics Europe GmbH – Kuvings Germany and consumers or business customers who purchase goods through our online shop.
Any terms and conditions that conflict with or deviate from our own will not be recognized.
The contract language is German.
§2 Conclusion of Contract

The offers presented on our website are non-binding invitations to purchase goods.

You may place one or more products in the shopping cart. During the checkout process, you will enter your personal details and select your preferred payment method and shipping options. By clicking the “Order” button, you make a binding offer to enter into a purchase agreement.

Once you receive an order confirmation email, your offer is accepted, and a binding purchase contract is concluded.
§3 Customer Information: Storage of Contract Text
Your order, along with all details of the concluded contract (e.g., product type, price, etc.), is stored by us.
We will send you the GTC by email; you can also access them at any time on our website after the contract has been concluded.
If you are a registered customer, you can access your previous orders in your customer login area (My janolaw).
§4 Customer Information: Correction Notice
You may correct your entries at any time before submitting your order by using the delete or back functions in your browser.
We will inform you of further correction options during the ordering process.
You may cancel the ordering process at any time by closing your browser window.
§5 Statutory Warranty Rights
All goods are covered by the statutory warranty rights provided by law.
§6 Limitation of Liability
We exclude liability for slightly negligent breaches of duty, provided these do not relate to essential contractual obligations, damages arising from injury to life, body, or health, guarantees, or claims under the Product Liability Act.
The same applies to breaches of duty by our legal representatives or vicarious agents.
Essential contractual obligations include, in particular, the duty to deliver the goods to you and to transfer ownership thereof, as well as to ensure that the goods are free of material and legal defects.
§7 Jurisdiction for Commercial Customers
For all disputes arising from this contract, the exclusive place of jurisdiction is our registered office, provided you are a merchant (Kaufmann) within the meaning of the German Commercial Code (HGB).
§8 Consumer Information: SMS Newsletter
(1) Purpose of Processing
By agreeing to SMS marketing from Kuvings during checkout or by subscribing through our sign-up tools, you consent to receive recurring text messages (regarding your order, abandoned cart reminders, promotional offers, and transactional messages such as review requests) from us, even if your mobile number is registered on a national or federal Do-Not-Call list (e.g., Robinson list).
Message frequency may vary. Consent is not a condition of purchase.
We reserve the right to change the phone numbers or short codes used to operate this service at any time, and you will be notified if this occurs.
You acknowledge that messages sent to a changed number (including STOP or HELP requests) may not be received, and we shall not be liable for failure to act on such messages.
To the extent permitted by law, you agree that we shall not be liable for any failed, delayed, or misdirected delivery of information, for any errors in such information, or for actions taken or not taken in reliance upon the service.

(4) Storage Period
Your email address and mobile number will be stored only for the duration of your SMS newsletter subscription.
(5) Right of Withdrawal
To unsubscribe from SMS marketing messages and notifications, reply STOP to any message we send you, or use the unsubscribe link included in each newsletter.
You acknowledge that alternative unsubscribe requests (e.g., using other words or contact methods) will not be considered valid.
We do not charge for the service, but you are responsible for any SMS or data charges imposed by your mobile carrier.
§9 Consumer Information: Transfer of Personal Data Abroad
Notice on international data transfer:
Our company transfers and entrusts the processing of certain personal data to foreign service providers for the purpose of providing specific marketing services.
These services include product discount information, product updates, membership guidance, and consent management for message delivery.
Refusing this data transfer will result in the unavailability of such marketing services. If you do not wish to participate, you may cancel your membership or submit an objection through our customer service center.

§10 Consumer Information: Participation in janoFair
We participate in the janoFair dispute resolution process, an alternative to government-recognized consumer arbitration boards.
If a dispute arising from our contractual relationship cannot be resolved amicably, you may use the free dispute resolution procedure provided by janoFair.
The statute of limitations for any claims is suspended during the procedure.
If no agreement is reached, you retain the right to pursue legal action.
